Driving too slowly in the fast lane isn’t just frustrating for other drivers, it’s also dangerous.

A slow driver in the fast lane impedes traffic. This causes cars to drive closer together and increases the likelihood of tailgating, which in turn increases the likelihood of an accident. In essence, one driver going too slowly in the fast lane creates a domino effect that reduces the safety of everyone behind him.

The standard flow of traffic is for faster cars to drive in the lanes farther to the left. If there’s a slow driver in the fast lane, it’s likely to cause a line of cars to accumulate behind him. Some are going to become frustrated and could develop road rage. Others are going to pull out of the fast lane and pass on the right, which is dangerous because it’s not the traditional passing lane. While it may seem like driving too slowly in the fast lane isn’t a big deal, it disrupts the flow of traffic, and any disruption can be deadly. If drivers are particularly upset, they could focus more on the slow driver than on their own driving, making them more likely to cause an accident.

Laws on driving in the left lane vary from state to state. On July 1, 2016, a law nicknamed the “Slow Poke Law” went into effect statewide in Tennessee. The law stipulates that drivers on multi-lane highways and the interstate can only use the left lane for passing other vehicles. The penalty for driving in the left lane without passing is a $50 fine and a misdemeanor charge.

There are a few exceptions where drivers can be in the left lane without passing under this law. Drivers can use the left lanes without passing if they need to exit or turn left from that lane, if the other lanes are obstructed, if a traffic control device forces drivers to go in that lane, or if there is inclement weather that makes the left lane safer.

The rate of speed at which a driver passes doesn’t matter, as long as the driver is going faster than traffic in the lane to his right.

It’s important to note that if you’re behind a driver who is going too slowly in the fast lane, tailgating is also illegal. The standard procedure is to flash your headlights at him a few times or lightly honk your horn. The driver may not realize that he’s going too slow for the fast lane, in which case he’s likely to move over and let you pass.

If the driver doesn’t move over, it’s up to you to use your best judgement in deciding what to do. You can stay in the fast lane while following at a safe distance, or you can switch to another lane. As long as you’re not driving faster than the speed limit, you’re not breaking the law, even if you end up passing someone on the right.

Multi-lane highways are set up that way for a reason. Driving in the lane that matches your current speed keeps traffic flowing smoothly. If you’re in the left lane and you’re not passing anybody, you should switch over one lane or more to your right, as it’s the law.
