According to an article which appeared in the 30 August 2024 edition of USA Today, more and more drivers are operating their vehicles without automobile insurance. This is happening despite Tennessee being a mandatory automobile insurance coverage state. Apparently Americans, and particularly Tennesseans, are taking a twofold risk of being caught without coverage, which warrants a fine and court appearance with proof of purchase after the fact, and/or getting involved in a car wreck. If the wreck is the uninsured’s fault, that at fault person endangers his or her personal assets begin attached to satisfy the claim against him or her. If it’s not the uninsured’s fault, that innocent person might not be able to recover anything by way of damages, especially if the at fault party is uninsured as well. Simply stated, it just doesn’t make sense to drive on America’s increasingly dangerous roads and highways without insurance, state mandated or not. Too risky, for the above cited reasons. We’re discovering in our personal injury practice, the majority of which involve car wrecks, that post-Covid society has become more impatient and angry, especially in automobiles on insufficient infrastructures. Consequently, we see wreck victims with more severe injuries, and insurance companies becoming more difficult to deal with in resolving claims, part of which is due to fewer insured motorists, thus less revenue for automobile insurance carriers. This, in turn, is creating a vicious cycle of diminished service via personnel loss in order to curb overall costs. All of that being said, however, the bottom line is life saving: Get automobile insurance coverage. Period. Tennessee’s minimal coverage is $25/$50K which, in cost-benefit terms, is a real bargain when one considers the potential consequences (after all, insurance is nothing more than a hedge against actuarial risk, essentially the buying of peace of mind). However, for potentially a few dollars more due to greater coverage, I advise everyone to thoroughly discuss all options with an insurance agent you trust.
